Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your access to and use of Niche Lens ("we", "us", or "our"), including our website, dashboard, APIs, and any related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. You may not use the Service if you are barred from doing so under applicable law or under any applicable sanctions or export control regulations.

3. Account Registration and Security

Niche Lens uses Supabase for authentication and account management. You agree to provide accurate, current, and complete information when creating an account and to keep it updated. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. 4. Description of the Service

Niche Lens is a niche research and trend-validation tool for print-on-demand sellers. It provides aggregated and processed data from various sources, including but not limited to marketplaces such as Etsy, Redbubble, and Amazon KDP, as well as trend and keyword tools. The Service is intended to help you evaluate potential niches and keywords, but does not guarantee any particular business outcome.

You understand and agree that Niche Lens provides informational and analytical insights only. Any decisions you make (for example, which niches to pursue or how to allocate advertising spend) are entirely your responsibility.

5. Plans, Payments, and Refunds

Payments for paid plans are processed via Paystack, a third-party payment processor. By initiating a purchase, you authorize Paystack to charge your selected payment method and authorize us to receive the resulting payment. We do not store full payment card details; these are handled by Paystack in accordance with their own policies.

Our current pricing and plan details, including any Lifetime Deal, are displayed on the Pricing page. A "Lifetime" or "Lifetime Deal" generally means a one-time payment for access to the Service for as long as we operate Niche Lens as a product and make that plan available, subject to applicable law.

Unless stated otherwise on the Pricing page, we offer a 14-day money-back guarantee for the Lifetime Deal. To request a refund, contact us at lennymwangi01@gmail.com within 14 days of purchase. After 14 days, refunds are generally not provided, except where required by law.

6. Acceptable Use

You agree not to misuse the Service. This includes, without limitation: attempting to bypass rate limits or access controls; scraping or systematically extracting large amounts of data to create a competing product or resell the data; reverse engineering or decompiling the Service except as permitted by law; using the Service in violation of any applicable law or third-party terms; or attempting to gain unauthorized access to other users' accounts or our systems.

7. Data Sources and Third-Party Services

Niche Lens relies on third-party services and data sources, including Supabase (authentication and backend), Paystack (payment processing), marketplaces such as Etsy, Redbubble, and Amazon KDP, and tools such as Google Trends. These third parties have their own terms and privacy policies. We are not responsible for the availability, accuracy, or policies of these third-party services, or for any changes they may make that affect the Service.

8. Intellectual Property

All intellectual property rights in the Service, including software, code, designs, interfaces, graphics, logos, and trademarks, as well as aggregated and processed metrics and visualizations, are owned by Niche Lens or its licensors. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your own business or personal use, in accordance with these Terms.

If you submit or upload any content to the Service, you retain ownership of that content, but grant us a non-exclusive, worldwide, royalty-free license to use, process, store, and display it solely to provide and improve the Service.

9. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that the insights or recommendations will result in any particular outcome.

Niche Lens is a research and validation tool and does not constitute financial, business, or legal advice. All decisions you make based on data from Niche Lens are at your own risk.

10. Limitation of Liability

To the maximum extent permitted by law, in no event will Niche Lens be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities arising from or related to your use of the Service. Our total aggregate liability for any claim arising out of or relating to the Service or these Terms will not exceed the amount you paid for the Service in the 12 months before the claim arose, or USD $100 if you have not paid, whichever is lower.

11. Indemnification

You agree to indemnify and hold harmless Niche Lens and its affiliates, and their respective officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of the Service, your violation of these Terms, or your violation of any law or third-party right.

12. Termination

You may stop using the Service at any time. We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or if your use poses a security or operational risk. Upon termination, your license to use the Service ends, but sections of these Terms that by their nature should survive will continue to apply.

13. Changes to the Service and Terms

We may modify or discontinue any part of the Service at any time. We may also update these Terms from time to time. If we make material changes, we will provide notice (for example, by email or in-app). Your continued use of the Service after the effective date of the updated Terms constitutes acceptance of the changes.

14. Governing Law

These Terms are governed by the laws applicable in your place of residence, unless a different jurisdiction is required by applicable law. Any disputes arising out of or relating to these Terms or the Service will be resolved in the courts of an appropriate jurisdiction, unless applicable law requires otherwise.
